2. Services

SeaYa! Madeira provides nautical tourist services, including sailing boat tours along the coast of Madeira Island.

3. Bookings and Payment

3.1. Booking Process

Bookings can be made through seayamadeira.pt, subject to availability. Booking confirmation will be sent by email after payment.

3.2. Pricing

All prices on the website include VAT at the applicable legal rate. Prices may change without notice, but confirmed and paid bookings will not be affected.

3.3. Payment Methods

We accept the following payment methods:

  • Credit/Debit Card (Visa, Mastercard)
  • PayPal
  • Multibanco
  • MB WAY

3.4. Confirmation

A booking is only confirmed after full payment is received and a confirmation email is sent.

4. Cancellation and Refund Policy

4.1. Cancellation by the Customer

Customers may cancel their booking under the following conditions:

  • Up to 14 days before the tour: Full refund (100%)
  • 7 to 13 days before: 50% refund
  • Less than 7 days before: No refund

4.2. Cancellation by SeaYa!

SeaYa! reserves the right to cancel tours for safety reasons (adverse weather conditions, technical issues, etc.). In such cases, customers are entitled to:

  • Rescheduling at no additional cost, or
  • Full refund within 14 days

4.3. Refund Method

Refunds will be processed via the same payment method used for the booking, within a maximum of 14 days after the request.

5. Participation Conditions

5.1. Requirements

  • Minors under 18 must be accompanied by a responsible adult
  • Pregnant women should consult their doctor before participating
  • People with specific medical conditions should inform us in advance

5.2. Safety

All participants must follow crew instructions. Non-compliance may result in exclusion from the tour without refund.

5.3. Equipment

All mandatory safety equipment is provided by SeaYa!. Participants are recommended to bring sunscreen, a hat, and water.

6. Changes and Rescheduling

Date changes may be requested up to 48 hours before the tour, subject to availability, at no additional cost.

7. Liability

SeaYa! holds mandatory civil liability insurance. We are not responsible for personal belongings lost or damaged during tours.

8. Data Protection

Personal data is processed in accordance with GDPR and our Privacy Policy.

9. Alternative Dispute Resolution (ADR)

In case of a consumer dispute, the consumer is entitled to refer the matter to an Alternative Dispute Resolution entity, pursuant to Portuguese Law no. 144/2015 of 8 September.

10. Right of Withdrawal

Under Portuguese Decree-Law no. 24/2014 of 14 February on distance contracts, consumers generally have a 14-day period to withdraw from a contract.

Exception applicable to nautical tourism services: pursuant to Article 17(l) of the said decree, the right of withdrawal does not apply to contracts for the provision of leisure services where the contract specifies a fixed date or period of execution. As such, SeaYa! Madeira boat tours, being scheduled for specific dates and times, are excluded from the 14-day withdrawal right.

Instead, the cancellation policy described in Section 4 of these Terms applies.

11. Complaints Book

In compliance with Portuguese Decree-Law no. 74/2017 of 21 June, SeaYa! Madeira provides an Electronic Complaints Book. You may submit a complaint at:

The physical Complaints Book is available at the boarding location (Marina da Quinta do Lorde, Caniçal).

12. Applicable Law and Jurisdiction

These terms and conditions are governed by Portuguese law. For any dispute not resolved through alternative means, the courts of the Madeira District shall have exclusive jurisdiction, with express waiver of any other.
